These terms and conditions govern your use of our server. Our terms have been provided and approved by legal documents provider. Please read the terms in full before you use our services. If you do not accept these terms, please do not use our service. Using the server implies that you accept these terms. We do occasionally update these terms so please refer back to them in the future.

Customer Hereby Agrees to The Following

• Customer agrees to pay for hosting services rendered in advance of each monthly service term.
• Non-Payment of services shall result in a 10-day notice of disconnection.  Customers failing to secure payment within 10 days of notice will incur service interruption.
• If an account is suspended three (3) or more times, or has been in a suspended status for sixty (60) days, the account will be deleted and all data will be removed from our servers.
• JBK Web Hosting reserves the right to terminate service immediately to any subscriber it deems, in its sole discretion, violates any condition of service including this Terms of Service.

Prohibited Content

Customers shall not be allowed to post, transmit, store data through the services, which in JBK Web Hosting’s sole determination, constitutes a violation of any relevant law, regulation or court order.

Prohibited content includes:

• code or content that facilitates any violation of, or describes ways to violate, this Terms of Service or
• phishing websites
• spam websites or
• link farms.

Network Security and Systems

A violation of systems or network security is strictly prohibited, and may result in criminal and civil liability. Examples of security violations include, without limitation, the following:

• Executing any form of software or application that will intercept data not intended for the Customer’s server.
• Introducing of any malicious programs into the network or server (e.g. viruses, worms, Trojan horses, and other executable intended to inflict harm).
• Denial of service attack: Interfering with or denying service to any user, host, or network other than the Customer’s host.
• Using any script or command to interfere with or to disable a user’s terminal session, locally or via Internet.
• Circumventing user authentication or security of any account, host or network.

Copyright Infringement

Hosting accounts may only be used for lawful purposes. Transmission, distribution, or storage of any information or material in violation of state regulation or law is prohibited. This includes materials protected by copyright, trademark or other intellectual property rights.  If you copy, distribute or install unauthorized software in ways that the license doesn’t allow, you are violating copyright law and JBK Web Hosting will cooperate with all enforcement agencies in relation to alleged copyright infringement housed on our servers.

Suspension, Transfers and Cancellation

JBK Web Hosting reserves the right to suspend any service to any Customer for violations of this Terms of Service. JBK Web Hosting will try to notify any Customer in a method that will least interfere customer service in resolving the problem. If a client wishes to transfer his/her domain to another provider, JBK will keep client’s account up to a period of 30 days from the day of transfer. After this day  account will be terminated and files won’t be recoverable. You may not transfer your domain registration to another host if your domain is due for renewal or has expired. Domain transfers can be requested at least thirty (30) days prior to the renewal date. For continued and repeated violations, JBK Web Hosting reserves the right to terminate the services rendered. To resume suspended services, a reconnection fee will be required.

Server Resources

If an account utilize an excessive amount of server resources (i.e. memory usage, CPU processing time and network resources) for a sustained period of time, JBK Web Hosting reserves the right to request that you either upgrade your hosting service package or reduce your account’s use of resources. JBK Web Hosting reserves the right to suspend or shutdown any hosting account that is adversely affecting server performance or network.

You are permitted to use our server for your own purposes and to print and download material from this server provided that you do not modify any content without our consent. Material on this server must not be republished online or offline without our permission.

The copyright and other intellectual property rights in all material on this server are owned by our licensors or us and must not be reproduced without our prior consent. You are not allowed to send bulk emails/newsletters without prior consent by management.

Server Uptime

We take all reasonable steps to ensure that this server is available 24 hours every day, 365 days per year. However, servers do sometimes encounter downtime due to network and, other technical issues.

This server may be temporarily unavailable due to issues such as system failure, maintenance or repair or for reasons beyond our control. Where possible we will try to give our clients advance warning of maintenance issues but shall not be obliged to do so.

Visitor Conduct

With the exception of personally identifiable information, the use of which is covered under our Privacy Policy any material you send or post to this Website shall be considered non-proprietary and not confidential.

When using this server you shall not post or send to or from this Website any material:

• For which you have not obtained all necessary consents;
• That is discriminatory, obscene, pornographic, defamatory, liable to incite racial hatred, in breach of confidentiality or privacy, which may cause annoyance or inconvenience to others, which encourages or constitutes conduct that would be deemed a criminal offence, give rise to a civil liability, or otherwise is contrary to the law in Zimbabwe;
• Which is harmful in nature including, and without limitation, computer viruses, Trojan horses, corrupted data, or other potentially harmful software or data.

We will fully co-operate with any law enforcement authorities or court order requiring us to disclose the identity or other details of any person posting material to this website in breach of the above paragraph.
